제1장 총칙

제1조(목적)

본 약관은 주식회사 문화방송과 아이엠비씨(이하, “회사”라 합니다)가 운영하는 웹사이트(이하, “MBC 아카이브”라 합니다, www.mbcarchive.com)에서 제공하는 인터넷 관련 서비스(이하, “서비스”라 합니다)를 이용함에 있어 이용자의 권리, 의무 및 책임 사항을 규정함을 목적으로 합니다.

제2조(정의)

1. “서비스”란 구현되는 단말기에 관계없이 회사가 회원에게 제공하는 MBC 아카이브의 제반 서비스를 의미합니다. 2. “회원”이란 본 약관에 따라 회사와 이용계약을 체결하고, 회사가 MBC 아카이브를 통해 제공하는 서비스의 이용고객을 의미합니다. 3. “회원ID”란 서비스 이용을 위한 회원 식별과 회원 자신의 비밀보호를 위해 회원 자신이 선정하고 회사가 승인한 문자와 숫자의 조합을 말합니다. 4. “비밀번호”란 부여받은 회원ID와 일치된 회원임을 확인하고 자신의 비밀보호를 위해 회원이 설정한 문자와 숫자의 조합을 말합니다. 5. “개인정보”란 생존하는 개인에 관한 정보로서 해당 정보에 포함되어 있는 성명, 생년월일 등의 사항에 의하여 해당 개인을 식별할 수 있는 정보(해당 정보만으로는 특정 개인을 식별할 수 없더라도 다른 정보와 용이하게 결합하여 식별할 수 있는 것을 포함)를 말합니다. 6. “게시물”이란 회원이 서비스를 이용함에 있어 서비스상에 게시한 부호ㆍ문자ㆍ음향ㆍ음성ㆍ화상ㆍ동영상 등의 정보 형태의 글, 사진, 동영상 및 각종 파일과 링크 등을 의미합니다. 7. “유료서비스"란 회사가 유료로 제공하는 각종 온라인디지털콘텐츠 및 제반 서비스를 의미합니다.

제3조(약관의 효력 및 변경)

1. 본 약관은 회사가 서비스 초기 화면을 통하여 게시하거나 이메일 등 기타의 방법으로 회원에게 개별 통지함으로써 효력이 발생합니다. 2. 본 약관에 동의하여 회원가입을 완료한 회원은, 회사가 제공하는 MBC 아카이브를 별도의 추가 가입 절차 없이 편리하게 이용할 수 있습니다. MBC 아카이브를 이용함에 있어 회원과 회사간의 권리, 의무 및 책임 사항, 이용 조건 및 절차 등은 서비스 별 약관이나 세부 지침의 규정이 없는 사항은 본 약관의 내용을 따릅니다. 3. 회사는 관련 법령에 반하지 않는 범위 내에서 본 약관의 내용을 변경할 수 있으며, 적용 일자 및 개정 사유를 명시하여 현행 약관과 함께 그 적용 일자 10일 이전부터 적용 일자 전일까지 제1항의 방식으로 공지합니다. 다만 회원에게 불리하게 약관 내용을 변경하는 경우에는 개정 약관의 적용 일자 30일 전부터 적용 일자 전일까지 공지하는 것 외에 이메일과 MBC 아카이브의 공지사항을 통해 별도로 통지합니다. 4. 전항에 따른 시행일 이후에 서비스를 이용하는 회원은 변경된 약관에 동의한 것으로 간주합니다. 다만 회원은 변경된 약관에 동의하지 않을 경우 이용계약을 해지할 수 있습니다. 5. 유료서비스를 이용하는 회원은 본 약관의 개정에 동의하지 아니하여 이용계약을 해지하는 경우에는 별도의 유료서비스 약관에 정한 환불정책을 따릅니다.

제4조(약관의 해석 및 준칙)

1. 회사는 개별 서비스에 대하여 별도의 이용약관 및 정책을 둘 수 있으며, 해당 내용이 본 약관과 상충할 경우에는 개별 서비스에 대한 이용약관 및 정책이 우선하여 적용됩니다. 2. 본 약관에 명시되지 아니한 사항에 대해서는 전기통신기본법, 전기통신사업법, 정보통신망 이용촉진 및 정보보호 등에 관한 법률(이하, “정통망법”이라 합니다), 개인정보보호법, 기타 관련 법령에 따릅니다.

제2장 서비스 이용계약

제5조(이용신청)

1. 서비스 이용을 희망하는 회원은 회사가 정한 소정의 양식에 정한 사항을 기재함으로써 이용신청을 합니다. 2. 제1항에 따른 회원이 이용신청 양식에 기재하는 모든 정보는 진실에 부합하는 정보로 간주합니다. 실명이나 실제 정보를 입력하지 않은 이용신청자는 법적인 보호를 받을 수 없으며, 서비스 이용계약을 해지당하거나 서비스 이용의 제한을 받을 수 있습니다.

제6조(이용신청 및 승낙)

1. 회사는 제5조에 따른 이용신청에 대하여 특별한 사정이 없는 한 접수 순서대로 이용신청을 승낙합니다. 2. 회사는 다음 각 호에 해당하는 경우 이용신청에 대한 승낙을 제한할 수 있고, 그 사유가 해소될 때까지 승낙을 유보할 수 있습니다. ① 서비스 관련 설비에 여유가 없는 경우 ② 서비스의 제공 및 유지를 위한 기술적 장애 또는 이용신청을 즉시 승낙할 수 없는 업무상 장애 사유가 발생한 경우 ③ 제5조에 따라 기재한 이용신청 정보 중 미비 사항에 대한 보완이 필요하다고 판단되는 경우 3. 회사는 다음 각 호에 해당하는 경우 이용신청에 대해서는 이를 승낙하지 아니 할 수 있습니다. ① 본인의 실명으로 신청하지 않은 경우 ② 다른 사람의 명의를 사용하여 신청한 경우 ③ 이용신청 시 기재 사항을 허위로 기재하거나 누락한 경우 ④ 사회의 안녕과 질서 혹은 미풍양속을 저해할 목적으로 신청한 경우 ⑤ 제16조 제5항에 따라 회원자격을 상실한 적이 있는 경우 ⑥ 회사가 제공하는 유료서비스를 이용함에 있어 타인의 신용카드나 유ㆍ무선 전화, 은행 계좌 등 결제수단을 무단으로 이용하거나 도용한 경우 ⑦ 기타 회사가 정한 이용신청 요건이 미비된 경우 4. 제2항 또는 제3항에 따라 이용신청의 승낙을 유보하거나 승낙하지 아니하는 경우, 회사는 이를 이용신청자에게 알려야 합니다. 다만, 회사의 귀책사유 없이 이용신청자에게 통지할 수 없는 경우는 예외로 합니다. 5. 회사는 회원에 대해 영화 및 비디오물의 진흥에 관한 법률, 청소년보호법 등 관련 법령에 따른 등급 및 연령 준수를 위하여 이용에 차등을 둘 수 있습니다.

제7조(회원에 대한 통지)

1. 회사가 회원에 대한 통지를 하는 경우, 회원이 회사와 미리 약정하여 지정한 이메일 주소로 할 수 있습니다. 2. 회사는 불특정다수 회원에게 통지할 경우 1주일 이상 MBC 아카이브의 공지사항에 게시함으로써 개별 통지를 갈음할 수 있습니다. 다만, 회원 본인의 거래와 관련하여 중대한 영향을 미치는 사항은 개별통지 합니다.

제8조(구매신청)

회원은 MBC 아카이브에서 다음 또는 이와 유사한 방법으로 재화 등을 구매 신청하며, 회사는 회원이 재화 등을 구매신청함에 있어서 다음의 각 항의 내용을 알기 쉽게 제공하여야 합니다. 1. 재화 등의 검색 및 선택 2. 약관 내용, 환불이 제한되는 서비스, 최소제작비 등의 비용부담과 관련된 내용에 대한 확인 3. 재화 등의 구매신청 및 이에 관한 확인 또는 회사의 확인에 대한 동의 4. 결제방법의 선택

제9조(계약의 성립)

1. 회사는 제8조와 같은 구매신청에 대하여 다음 각 호에 해당하면 승낙하지 않을 수 있습니다. ① 신청 내용에 허위, 기재누락, 오기가 있는 경우 ② 초상권에 대한 해결이 명확하지 않은 경우 ③ 기타 구매신청에 승낙하는 것이 회사 기술상 현저히 지장이 있다고 판단하는 경우 2. 회사의 승낙은 제11조 제1항에 따른 이메일 통지로 진행되며, 구매신청한 회원에게 도달한 시점에 성립한 것으로 봅니다. 3. 회사의 승낙의 의사표시에는 회원의 구매신청에 대한 확인 및 판매가능 여부, 구매신청의 정정 취소 등에 관한 정보 등을 포함하여야 합니다.

제10조(지급방법)

회원은 MBC 아카이브에서 구매한 재화 등에 대한 대금지급을 다음 각 항의 방법으로 할 수 있습니다. 1. 신용카드 결제 2. 실시간 계좌이체 3. 무통장 입금 4. 기타 전자적 지급 방법

제11조(심사 결과 통지, 결제, 다운로드)

1. 회사는 회원의 구매신청이 있는 경우 심사 결과 및 결제 금액을 회원의 이메일로 통지합니다. 2. 결제는 회사가 MBC 아카이브로 소재를 공급한 후 7일 이내에 가능합니다. 3. 다운로드는 회원의 결제 후 7일 이내에 가능합니다.

제12조(개인정보의 보호)

1. 회사는 통신비밀보호법, 전기통신사업법, 정통망법, 개인정보보호법 등 정보통신 서비스 제공자가 준수하여야 할 관련 법규를 바탕으로 개인정보 보호정책을 만들어 이를 시행합니다. 다만 MBC 아카이브 이외에 배너광고 기타 링크를 통해 연결된 타 웹사이트에 대해서는 본 약관 및 회사의 개인정보보호정책이 적용되지 아니합니다. 2. 회사는 본 약관 및 개인정보보호정책에 근거하여 회원 정보를 회사의 각종 마케팅, 홍보 또는 서비스의 확대 등을 위하여 이용할 수 있으며, 회원이 이를 원치 아니할 경우에는 언제든지 수신을 거부할 수 있습니다. 3. 회사가 수집하는 개인정보는 서비스 제공에 필요한 최소한으로 하되, 서비스의 제공 및 확대를 위하여 필요한 부가정보를 회원의 동의 하에 수집ㆍ관리할 수 있습니다. 4. 회사는 회원의 개인정보를 회원의 동의 없이 외부에 공개하거나 제3자와 공유하지 않습니다. 다만, 다음 각 호에 해당하는 경우를 예외로 합니다. ① 회원의 동의를 얻은 경우 ② 회원이 서비스를 이용하여 전자게시판 등에 남긴 시청자 의견, 설문조사 참여결과 등 회사가 제공하는 각종 서비스를 이용하기 위하여 본인 여부를 확인할 필요가 있는 경우 (단, 회사는 필요최소한의 범위에서 개인정보를 제공합니다) ③ 법률의 규정 또는 법원 등 국가기관의 적법한 명령 등에 의해 회원의 개인정보 제공이 요구된 경우 ④ 서비스 제공에 따른 요금 정산 또는 상품 배송을 위하여 필요한 경우 ⑤ 통계작성, 학술연구 또는 시장조사를 위하여 개인을 식별할 수 없는 형태로 제공하는 경우 5. 다음 각 호의 경우, 회사는 회원으로부터 수집한 개인정보 중 제한된 범위의 정보를 제휴사가 이용하도록 제공할 수 있습니다. 이 경우 회원은 언제든지 이메일 등을 통해 원치 않는 서비스를 거절할 수 있습니다. ① 제휴하고 있는 인터넷 쇼핑 서비스 사업자, 커뮤니케이션 서비스 사업자, 제조업자, 도소매업자, 통신업자, 사업 서비스업자, 교육 서비스업자, 오락, 문화 및 운동 관련 서비스업자, 그 밖의 각종 전문 콘텐츠 사업자 혹은 비즈니스 사업자가 이메일, TM(텔레마케팅), DM(우편), SMS(핸드폰 문자메시지) 등을 이용하여 광고 및 마케팅 활동을 수행하고자 하는 경우, 회사는 제휴사에게 개인정보를 제공하는 것에 대하여 회원의 사전동의를 받아 전송합니다. ② 제휴하고 있는 신용카드, 할부금융, 보험, 보험대리 및 중개 등의 금융 및 보험업 또는 이와 관련된 서비스 사업자가 이메일, TM(텔레마케팅), DM(우편), SMS(핸드폰의 문자메시지) 등을 이용하여 광고 및 마케팅 활동을 수행하고자 하는 경우. 회사는 제휴사에게 개인정보를 제공하는 것에 대하여 회원의 사전동의를 받아 전송합니다. 6. 회원은 회사에 제공한 자신의 개인정보를 열람, 정정, 갱신할 수 있습니다. 또한, 회사에 개인정보를 제공하는데 동의한 이후라도 언제든지 이의 철회(회원탈퇴)를 요청할 수 있습니다. 7. 각 회원들의 개인적 환경이나 취향에 맞는 특화된 맞춤서비스를 제공하기 위하여 회사는 회원들의 정보를 저장하고 수시로 불러오는 '쿠키(cookie)'를 사용합니다. 쿠키는 웹사이트가 회원의 컴퓨터 웹 브라우저로 전송하는 소량의 정보로 PC 하드디스크에 저장되기도 합니다. 회원가 웹사이트에 접속을 하면 회사의 서버는 회원의 웹 브라우저에 있는 쿠키의 내용을 읽고 회원의 추가정보를 회원의 컴퓨터 상에서 찾아 접속에 따른 성명 등의 추가 입력 없이 서비스를 제공할 수 있습니다. 쿠키는 회원의 컴퓨터를 식별하지만 회원 개개인을 개별적으로 식별하지는 않습니다. 회사는 이 쿠키를 이용하여 회원들이 방문한 각 서비스에 대한 방문 및 이용 형태, 회원 규모 등을 파악하여 더욱 더 편리한 서비스를 만들 수 있습니다. 회원들은 웹 브라우저의 옵션을 조정하여 쿠키에 대한 사용 여부를 선택하실 수 있습니다. 즉, 모든 쿠키를 다 받아들이거나, 쿠키가 설치될 때 통지를 보내도록 하거나, 아니면 모든 쿠키를 거부하실 수도 있습니다. 다만, 회원들은 회사에 접속한 후 로그인(LOG-IN)하여 서비스를 이용하기 위해서는 쿠키를 허용하여야 합니다. 8. 회사는 개인정보의 수집목적 또는 제공받은 목적을 달성한 이후에는 지체 없이 재생 불가능한 기술적인 방법을 사용하여 개인정보를 파기합니다. 단, 상법 등 법령의 규정에 의하여 보관의무가 규정되어 있거나 회원 본인의 동의를 받았을 경우, 사전에 고지한 보유기간이 경과하지 않은 경우, 소송이나 분쟁이 발생하거나 발생할 가능성이 있어 관련 개인정보의 보유가 법적 대응을 위하여 필요한 경우 등에는 필요한 기간 동안 개인정보를 보유할 수 있습니다. 다만, 이 기간 동안의 개인정보 열람 및 이용은 해당 사유로 국한되며 그 후에도 계속 보유할 필요가 있을 경우에는 회원에게 이러한 사실을 고지하고 그에 대한 동의를 받습니다. 9. 회원이 장기간 서비스를 이용하지 아니한 경우, 회사는 회원자격 정리기간을 정하여 MBC 아카이브 또는 이메일을 통해 일정 기간 동안 서비스를 이용하지 아니할 경우 이용계약이 해지될 수 있음을 고지하고, 그 기간 동안 해당 회원이 서비스를 이용하지 아니하거나 별도의 이의 제기를 하지 아니할 경우, 해당 회원의 회원자격을 해지하고 그의 개인정보를 삭제할 수 있습니다. 10. 일시적인 목적(이벤트, 설문조사 등)을 위한 것임을 밝히고 제공받거나 이용에 관하여 동의를 받은 개인정보는 그 목적이 달성된 이후에는 회원의 의사에 따라 재생할 수 없는 방법으로 디스크에서 완전히 삭제합니다.

제13조(계약 사항의 변경)

1. 회원은 개인정보 관리 화면을 통하여 언제든지 본인의 개인정보를 열람하고 수정할 수 있습니다. 다만 서비스의 관리 및 유지를 위하여 필요한 실명, 아이디 등 일부 정보는 임의로 수정할 수 없습니다. 2. 회원은 이용신청 시 기재한 사항이 변경되었을 경우 회사가 제공하는 온라인 양식에 따라 수정해야 하며, 회원정보를 변경하지 아니하여 발생하는 불이익에 대하여 회사는 책임지지 아니합니다.

제14조(회원ID 및 비밀번호에 대한 권리)

1. 회원ID와 비밀번호에 관한 관리책임은 회원에게 있으며, 이를 제3자가 이용하도록 하여서는 아니됩니다. 2. 회사는 다음 각 호에 해당하는 사유가 있을 경우, 해당 회원ID의 이용을 제한할 수 있습니다. ① 회원ID가 비밀번호와 유사하거나 기타 개인정보의 유출 단서가 될 수 있다고 판단되는 경우 ② 회원ID가 반사회적 또는 미풍양속에 어긋나는 표현이라고 인정되는 경우 ③ 회원ID가 회사 또는 회사의 운영자나 관계자로 오인될 우려가 있는 경우 3. 회원은 자신의 회원ID 또는 비밀번호가 도용되거나 제3자에 의하여 사용되고 있음을 인지하는 즉시 회사에 이 사실을 통지하고 회사의 적절한 안내와 지시에 따라야 합니다. 4. 회원이 제1항에 불구하고 제3자로 하여금 자신의 회원ID 및 비밀번호를 이용하도록 하거나, 제3항에 따라 회사에 통지하지 아니하거나, 통지 후 회사의 안내와 지시에 적절히 따르지 아니함으로써 발생한 불이익에 대하여 회사는 책임지지 아니합니다.

제3장 계약 당사자의 의무

제15조(회사의 의무)

1. 회사는 특별한 사정이 없는 한 회원이 서비스 이용을 신청한 날에 서비스를 이용할 수 있도록 합니다. 2. 회사는 본 약관에서 정한 바에 따라 계속적이고 안정적인 서비스의 제공을 위하여 지속적으로 노력하며, 설비에 장애가 생기거나 멸실된 때에는 지체 없이 이를 수리 복구하여야 합니다. 다만 천재지변, 비상사태 또는 그 밖에 부득이한 경우나 회사의 사정상 서비스 제공이 곤란한 경우에는 그 서비스를 일시 중단하거나 중지할 수 있습니다. 3. 회사는 회원으로부터 소정의 절차에 의해 제기되는 의견이나 불만이 정당하다고 인정할 경우에는 적절한 절차를 거쳐 처리하여야 합니다. 처리시 일정 기간이 소요될 경우 회원에게 그 사유와 처리 일정을 알려주어야 합니다. 4. 회사는 회원의 프라이버시 보호와 관련하여 본 약관 및 기타 법령에 정한 개인정보의 보호에 관한 규정들을 준수합니다. 5. 회사는 이용계약의 체결, 계약사항의 변경 및 해지 등 회원과의 계약 관련 절차 및 내용 등에 있어 회원에게 편의를 제공하도록 노력합니다.

제16조(회원의 의무)

1. 회원은 관련 법령, 본 약관의 각 규정, 이용안내 및 서비스와 관련하여 공지하거나 통지한 주의사항 등을 준수하여야 하며, 기타 회사의 업무에 방해되는 행위를 하여서는 아니됩니다. 2. 회원은 내용별로 회사가 서비스 공지사항에 게시하거나 별도로 공지한 이용제한 사항을 준수하여야 합니다. 3. 회원은 회사의 사전승낙 없이는 서비스를 이용하여 영업 기타 영리적 목적의 활동을 할 수 없으며, 그 영업활동의 결과와 회원이 약관에 위반한 영업활동을 하여 발생한 결과에 대하여 회사는 책임을 지지 않습니다. 회원은 이와 같은 영업활동으로 회사가 손해를 입은 경우 회사에 대하여 손해배상 의무를 집니다. 4. 회원은 회사의 명시적인 동의가 없는 한 서비스의 이용권한, 기타 이용계약상의 지위를 타인에게 양도, 증여할 수 없으며, 이를 담보로 제공할 수 없습니다. 5. 회원은 서비스 이용과 관련하여 다음 각 호에 해당되는 행위를 하여서는 안됩니다. ① 이용신청 또는 개인정보 변경 시 허위 내용을 기재하는 행위 ② 다른 회원의 아이디와 비밀번호 등 기타 개인정보를 수집하거나 도용하는 행위 ③ 본 서비스를 통하여 게시되거나 제공된 정보를 회사의 사전승낙 없이 본 서비스 내에서의 이용 이외의 목적으로 복제ㆍ전송ㆍ이용하는 행위 ④ 회사 또는 타인의 특허, 상표, 영업비밀, 저작권 기타 지적재산권을 침해하는 행위 ⑤ 외설적이거나 폭력적인 내용 기타 타인에게 혐오감을 주거나 공공질서 및 미풍양속에 반하는 문장, 도형, 메시지, 화상, 음성 기타의 정보를 회사의 서비스를 통해 게시ㆍ전송ㆍ공개하거나 기타의 방법으로 제3자에게 유포하는 행위 ⑥ 회사 또는 타인의 명예를 훼손하거나 업무를 방해하는 행위 ⑦ 타인의 초상, 성명, 프라이버시에 관한 권리를 침해하는 행위 ⑧ 회사의 서비스 기타 시스템을 해킹하거나 바이러스, 스파이웨어 기타 악성코드를 전송ㆍ유포함으로써 서비스의 정상적 운영을 방해하거나 타인의 서비스 이용 또는 접근을 저해하는 행위 ⑨ 회사의 직원이나 관리자를 가장하거나 사칭하여 내용물을 게시, 등록하거나 메일을 발송하는 행위 ⑩ 기타 관계법령 및 회사의 기타 서비스 이용약관에 관한 기준 및 지침에 위배되는 행위

제4장 서비스 이용

제17조(서비스의 제공 등)

1. 회사는 회원에게 아래와 같은 서비스를 제공합니다. ① 영상, 오디오, 이미지 등의 소재 미리보기 서비스 ② 소재 주문 및 결제, 소재 다운로드 서비스 ③ 기타 회사가 추가로 고안하거나 다른 회사와의 제휴계약 등을 통해 회원에게 제공하는 일체의 서비스 2. 회사는 컴퓨터 등 정보통신설비의 보수점검, 교체 및 고장, 통신두절 또는 운영상 상당한 이유가 있는 경우 서비스의 제공을 일시적으로 중단할 수 있습니다. 이 경우 회사는 본 약관상 정한 방법에 따라 회원에게 통지하되, 회사가 사전에 통지할 수 없는 부득이한 사유가 있는 경우에는 사후에 통지할 수 있습니다. 3. 회사는 서비스의 제공에 필요한 경우 정기점검을 실시할 수 있으며, 정기점검시간은 서비스제공화면에 공지한 바에 따릅니다. 4. 회사는 각 서비스 이용에 필요한 최소한의 기술 사양에 관한 정보를 MBC 아카이브의 공지사항에서 제공합니다. 회원은 각 서비스를 이용하기 위하여 서비스에 이용할 단말기 사양, 유무선 통신망의 품질 등이 해당 서비스의 이용에 적합한지 여부를 사전에 확인하여야 합니다. 5. 회원은 서비스를 이용함에 있어 클라이언트 등 동영상 플레이, 패치, 업데이트 등을 위한 목적으로 설치되는 프로그램(이하, “프로그램”이라 합니다) 및 원활한 프로그램 구동을 위해 추가적으로 필요한 프로그램, 소프트웨어 등(이하, “부가 프로그램”이라 합니다)의 설치가 필요할 수 있습니다. 프로그램 및 부가 프로그램의 설치는 회사가 제공하는 서비스를 이용하기 위해 필요한 사항으로, 설치되는 프로그램 용량 및 종류 등은 서비스 제공 내용에 따라 상이할 수 있습니다. 각 프로그램은 ‘제어판>프로그램 추가/제거’에서 선택하여 삭제할 수 있습니다.

제18조(서비스의 변경 등)

1. 회사는 운영상ㆍ기술상의 필요에 따라 제공하고 있는 서비스의 전부 또는 일부를 변경할 수 있습니다. 2. 서비스의 내용, 이용방법, 이용시간에 대하여 변경이 있는 경우에는 변경사유, 변경될 서비스의 내용 및 제공일자 등을 변경 전 7일 이상 해당 서비스 초기 화면에 게시합니다. 3. 회사는 무료로 제공되는 서비스의 일부 또는 전부를 회사의 정책 및 운영의 필요에 따라 수정하거나 중단 또는 변경할 수 있습니다.

제19조 (정보의 제공)

1. 회사는 회원이 서비스 이용을 위하여 필요하다고 인정되는 다양한 정보를 공지사항이나 이메일 등의 방법으로 회원에게 제공할 수 있습니다. 2. 회사는 회원에게 편리하고 다양한 서비스를 제공하기 위하여 관련 법령이 정한 절차와 제한 범위 내에서 회원으로부터 수집한 개인정보를 이용하여 회사가 제공하는 각종 서비스에 대한 정보, 광고, 타사의 상품이나 서비스, 이벤트 등에 대한 광고를 회사가 직접 또는 제휴사와 함께 이메일, DM(우편) 등의 방법으로 광고하거나 제공할 수 있습니다. 이 경우 회원은 관련 법에 따른 거래 관련 정보 및 고객문의 등에 대한 답변 등을 제외하고는 언제든지 이메일 등에 대해서 서비스 및 광고를 거절할 수 있습니다. 3. 회사는 서비스에 관한 정보 등의 기타 마케팅 및 홍보활동을 함에 있어 TM(텔레마케팅), SMS(핸드폰 문자메세지) 및 모사전송기기에 의하여 그 정보를 회원에게 전송하고자 하는 경우, 회원의 사전 동의를 받아 전송합니다. 다만 회원의 거래 관련 정보 및 고객문의 등에 대한 답변은 그렇지 아니합니다. 4. 회사는 서비스의 운영과 관련하여 서비스 화면, 홈페이지, 이메일 등에 광고를 게재할 수 있으며, 광고가 게재된 이메일 등을 수신한 회원은 수신거절을 할 수 있습니다. 5. 기타 회원의 정보 제공 및 이용에 관한 세부 사항은 회사가 정하는 개인정보보호정책에 정한 바를 따릅니다.

제20조(요금 및 유료정보 등)

1. 회사가 제공하는 서비스는 무료서비스와 유료서비스가 있습니다. 회사 및 제휴사가 제공하는 별도의 유료정보에 대해서는 해당 정보에 명시된 요금을 지불하여야 사용 가능합니다. 2. 회사가 제공하는 유료서비스를 이용하고자 하는 회원은 본 약관에 대한 동의와 별도로 유료서비스 및 이용권 이용약관에 동의하고 회사에 이용요금(또는 회비)를 납부하여야 합니다.

제21조(회원의 게시물)

1. 회사는 회원이 서비스 내에서 작성ㆍ게시하거나 등록한 문자, 문서, 그림, 음성 또는 이들의 조합으로 이루어진 정보 등(이하, “게시물”이라 합니다)이 다음 각 호에 해당한다고 판단되는 경우에 사전통지 없이 삭제하거나 이동 또는 등록을 거부할 수 있습니다. ① 타인을 비방하거나 명예를 손상시키는 내용인 경우 ② 공공질서 및 미풍양속에 위반되는 내용인 경우 ③ 범죄적 행위에 결부된다고 인정되는 내용일 경우 ④ 회사 또는 타인의 저작권 기타 법률상 보호받는 권리를 침해하는 내용인 경우 ⑤ 회사에서 규정한 게시기간을 초과한 경우 ⑥ 회원이 게시판에 음란물을 게재하거나 음란 사이트를 링크하는 경우 ⑦ 회사에서 정한 게시물 작성 및 게시 원칙에 어긋나거나 게시판의 성격에 부합하지 않는 게시물의 경우 ⑧ 회사의 정상적인 서비스 운영을 방해하는 경우 ⑨ 영리를 목적으로 하는 광고성 내용인 경우 ⑩ 기타 관계법령에 위반된다고 판단되는 경우 2. 회원의 게시물이 정보통신망의 이용촉진 및 정보보호 등에 관한 법률, 저작권법, 개인정보보호법 기타 관련 법령에 위반되는 내용을 포함하는 경우, 권리자는 관련 법령이 정한 절차에 따라 해당 게시물의 게시중단 또는 삭제 등을 요청할 수 있으며, 회사는 관련 법령에 정해진 바에 따른 조치를 취합니다. 3. 회사는 제1항에 따른 권리자의 요청이 없는 경우에도 권리침해가 인정될만한 사유가 있거나 기타 회사 정책 및 관련 법령에 위반되는 게시물에 대해서는 관련 법령에 정한 바에 따라 해당 게시물에 대해 임시조치 등을 취할 수 있습니다.

제22조(저작권의 귀속 및 이용제한)

1. 서비스에 대한 저작권 및 기타 지적재산권은 회사에 귀속됩니다. 다만 회원의 게시물 및 기타 제휴계약 등에 근거하여 제공된 저작물 등은 MBC 방송 프로그램을 직접적으로 게시한 경우 등이 아니면 제외합니다. 2. 회원은 MBC 아카이브를 이용함으로써 얻은 정보 중 회사에게 지적재산권이 귀속된 정보를 회사의 사전 승낙 없이 복제, 송신, 출판, 배포, 방송 기타 방법에 의하여 영리목적으로 이용하거나 제3자에게 이용하게 하여서는 안됩니다. 3. 회사는 약정에 따라 회원에게 귀속된 저작권을 사용하는 경우 당해 회원에게 통보하여야 합니다.

제23조(광고게재 및 광고주와의 거래)

1. 회사는 MBC 아카이브와 회원에게 보내는 이메일 등 기타 서비스의 제공과정에서 배너광고 등의 형태로 광고를 게재할 수 있습니다. 2. 제1항에 따라 이루어진 광고주의 판촉활동에 대하여 회원은 자신의 책임하에 그러한 판촉활동에 참여하거나 거래하며, 회사는 광고주와 회원 사이의 거래 및 교섭 과정에서 발생하는 일방 당사자의 손해 또는 손실에 대하여 책임을 부담하지 아니합니다.

제24조(서비스 이용 책임)

1. 회원은 회사의 권한 있는 사원이 서명한 명시적인 서면을 통하여 구체적으로 허용된 경우를 제외하고는 서비스를 이용하여 상품 등을 판매하는 영업활동을 할 수 없으며 특히 해킹, 돈벌이 광고, 음란 사이트 등을 통한 상업행위, 상용S/W 불법배포 등을 할 수 없습니다. 이를 어기고 발생한 영업활동의 결과 및 손실, 관계기관에 의한 구속 등 법적 조치 등에 관해서 회사는 책임을 지지 않습니다. 2. 회사와 합의되지 않거나 동의를 받지 않은 다음과 같은 행위는 저작권 침해 및 부정경쟁행위에 해당하며, 회사는 해당 행위자 및 관련 책임자에 대하여 민,형사상 조치를 취할 수 있습니다. ① 회사의 명시적인 사전 서면 허가 없이 데이터 등을 추출하기 위하여 로봇(봇), 크롤러, 스파이더, 스크레이퍼, 매크로 프로그램 또는 기타 자동화 수단이나 수동 프로세스를 이용하여 회사의 웹, 앱, 서버에 접근하거나 회사 서비스에 포함된 콘텐츠 및 정보를 모니터링, 복제, 수집, 확인, 정리, 사용하는 등의 행위를 허용하지 않습니다. ② 서비스를 통해 제공하는 제반 콘텐츠 및 온라인 서비스, 외부 플랫폼을 통해 유통되는 모든 콘텐츠의 내용을 이용하거나 인공지능(AI) 학습 목적으로 활용하고자 할 경우 회사와 사전에 반드시 합의해야 합니다. 특히 영리 목적의 경우 회사와 적법한 계약에 따라야 합니다. 공익 및 비영리 목적인 경우에도 회사의 동의를 받아야 합니다.

제25조(서비스 제공의 중지 등)

1. 무료서비스의 경우 회사는 회사의 필요에 따라 서비스의 전부 또는 일부를 수정하거나 중지할 수 있습니다. 2. 회사는 다음 각 호에 해당하는 경우 서비스 제공을 중지할 수 있습니다. ① 서비스용 설비의 보수 등 공사로 인한 부득이한 경우 ② 전기통신사업법에 규정된 기간통신사업자가 전기통신 서비스를 중지했을 경우 ③ 회사의 사정에 의하여 서비스 제공이 곤란한 경우나 불가항력적 사유가 있는 경우 3. 회사는 국가비상사태, 정전, 서비스 설비의 장애 또는 서비스 이용의 폭주 등으로 정상적인 서비스 이용에 지장이 있는 때에는 서비스의 전부 또는 일부를 제한하거나 중지할 수 있습니다.

제5장 계약 해지 및 이용 제한

제26조(계약 해지 및 이용 제한)

1. 회원은 언제든지 온라인상 제공되는 양식을 통해 회원탈퇴를 회사에 신청할 수 있습니다. 2. 회사는 회원이 다음 각 호에 해당하는 행위를 하였을 경우 사전통지 없이 이용계약을 해지하거나 또는 기간을 정하여 서비스 이용을 중지시킬 수 있습니다. ① 타인의 개인정보, 회원ID 및 비밀번호를 도용하거나 허위의 정보로 가입한 경우 ② 주민등록법에 반하는 명의도용 또는 결제수단의 도용행위를 한 경우 ③ 같은 사용자가 다른 회원의 아이디로 이중등록을 한 경우 ④ 타인의 명예를 훼손하거나 모욕 기타 불이익을 주는 행위를 한 경우 ⑤ 회사, 다른 회원 또는 제3자의 지적재산권을 침해한 경우 ⑥ 공공질서 및 미풍양속에 저해되는 내용을 고의로 유포시킨 경우 ⑦ 영리적 목적을 위하여 서비스를 사용하거나 타인의 서비스 이용을 방해한 경우 ⑧ 회사의 서비스 운영을 고의로 방해한 경우 ⑨ 서비스의 안정적 운영을 방해할 목적으로 다량의 정보를 전송하거나 광고성 정보를 전송하는 경우 ⑩ 컴퓨터프로그램보호법 등에 반하는 불법프로그램의 제공 및 운영방해, 또는 정보통신망 이용촉진 및 정보보호 등에 관한 법률에 반하는 악성코드 등의 유포와 같이 정보통신 설비의 오작동이나 정보의 파괴를 유발시키는 컴퓨터 바이러스 프로그램 등을 유포하는 경우 ⑪ 정보통신윤리위원회 등 관련 행정기관의 시정요구가 있거나 불법선거운동과 관련하여 선거관리위원회의 유권해석을 받은 경우 ⑫ 회사의 서비스 정보를 이용하여 얻은 정보를 회사의 사전 승낙 없이 복제 또는 유통시키거나 상업적으로 이용하는 경우 ⑬ 게시판에 음란물을 게재하거나 음란 사이트를 링크하는 경우 ⑭ 불법통신 및 해킹, 접속권한의 초과행위 기타 관련 법령에 반하는 부정한 방법 또는 부당한 목적으로 서비스 또는 회사의 시스템 이용에 장애를 초래한 경우 ⑮ 본 약관을 포함하여 기타 회사가 정한 서비스 이용 조건을 위반한 경우 3. 회사는 회원이 제2항의 행위를 하거나 본 약관의 의무를 위반하는 경우, 그 위반행위의 중대성에 따라 경고, 일시 정지, 영구이용정지 등 서비스의 이용을 단계적으로 제한할 수 있습니다. 4. 회사는 본 약관에 정한 바에 따라 적법한 서비스 이용을 보장하고 회원을 보호하기 위하여 별도의 이용제한의 조건 및 내용에 대한 세부절차를 정할 수 있습니다. 5. 회원은 본 약관에 따른 이용제한 등에 대하여 회사가 정한 절차에 따라 즉시 이의신청을 할 수 있으며, 그 이의사유가 정당한 것으로 인정되는 경우 회사는 즉시 서비스의 이용을 재개합니다. 또한 회원의 고의·과실 없음이 입증된 경우 계정정지 기간만큼의 유료서비스 이용기간을 연장합니다.

제6장 손해배상 및 기타 사항

제27조(손해배상)

1. 회사가 제공하는 무료서비스를 이용하는 과정에서 발생한 회원의 손실 또는 손해에 관하여, 회사는 고의 또는 과실로 인하여 발생한 상당인과관계 있는 손해에 대하여 책임을 부담합니다. 다만 회원이 무료서비스를 이용하지 못한 자체에 대하여 회사는 배상책임이 없습니다. 2. 회사는 제휴사가 취급하는 상품 또는 용역에 대하여 책임을 지지 않습니다.

제28조(면책조항)

1. 회사는 천재지변 또는 이에 준하는 불가항력 및 기타 회사의 책임 없는 사유로 인하여 서비스를 제공할 수 없는 경우에는 서비스 제공에 관한 책임이 면제됩니다. 2. 회사는 회원의 귀책사유로 인한 서비스 이용 장애에 대하여 책임을 지지 않습니다. 3. 회사는 회원이 서비스를 통해 게재하거나 유포, 전송한 정보, 자료, 사실의 신뢰도, 정확성, 적법성, 안정성 등에 관하여 보장하지 않습니다. 4. 회사는 회원간 또는 회원과 제3자 상호간에 서비스를 매개로 하여 이루어진 거래에 대하여 책임을 부담하지 아니합니다. 5. 회사는 무료로 제공되는 서비스 이용과 관련하여 관련법에 특별한 규정이 없는 한 책임을 부담하지 아니합니다.

제29조(준거법 및 관할법원)

1. 회사와 회원간에 제기된 소송에 대해서는 대한민국 법률을 준거법으로 합니다. 2. 서비스 이용으로 발생한 분쟁에 대해 소송이 제기될 경우 관할은 제소 당시 회원의 주소에 의하고, 주소가 없는 경우 회사의 본점 소재지를 관할하는 법원을 전속적 관할법원으로 합니다. 3. 제소 당시 회원의 주소가 분명하지 아니한 경우에는 민사소송법에 따라 관할법원을 정합니다.

[부칙]

(시행일) 본 약관을 2025년 12월 1일부터 적용하고, 종전의 약관을 본 약관으로 대체합니다.

Chapter 1 General Provisions

Article 1 (Purpose)

The purpose of these Terms is to prescribe the rights, obligations, and responsibilities of users in connection with the use of internet-related services (hereinafter referred to as the “Service”) provided through the website (hereinafter referred to as “MBC Archive,” www.mbcarchive.com) operated by Munhwa Broadcasting Corporation and iMBC Co., Ltd. (hereinafter referred to as the “Company”).

Article 2 (Definitions)

1. “Service” means all services of MBC Archive provided by the Company to members, regardless of the device through which the services are implemented. 2. “Member” means a customer who has entered into a service agreement with the Company in accordance with these Terms and uses the services provided by the Company through MBC Archive. 3. “Member ID” means a combination of letters and numbers selected by a member and approved by the Company for member identification and protection of the member’s confidentiality when using the Service. 4. “Password” means a combination of letters and numbers set by a member to verify that the member corresponds to the assigned Member ID and to protect the member’s confidentiality. 5. “Personal Information” means information relating to a living individual that can identify that individual by name, date of birth, or other information included therein, including information that cannot identify a particular individual by itself but can be easily combined with other information to identify that individual. 6. “Post” means text, photographs, videos, various files, links, and other forms of information, including codes, characters, sounds, audio, images, and videos, posted by a member on the Service while using the Service. 7. “Paid Service” means any online digital content and related services provided by the Company for a fee.

Article 3 (Effectiveness and Amendment of the Terms)

1. These Terms become effective when the Company posts them on the initial service screen or individually notifies members by email or other means. 2. Members who complete membership registration by agreeing to these Terms may conveniently use MBC Archive provided by the Company without a separate additional registration procedure. In using MBC Archive, matters not provided for in service-specific terms or detailed guidelines, including rights, obligations, and responsibilities between members and the Company, and conditions and procedures of use, shall be governed by these Terms. 3. The Company may amend these Terms within the scope permitted by applicable laws and regulations. The Company shall specify the effective date and reason for amendment and notify members in the manner set forth in Paragraph 1 from at least ten (10) days before the effective date until the day before the effective date, together with the current Terms. However, if the amendment is unfavorable to members, the Company shall notify members separately by email and through notices on MBC Archive, in addition to posting such notice from thirty (30) days before the effective date until the day before the effective date. 4. A member who uses the Service after the effective date under the preceding paragraph shall be deemed to have agreed to the amended Terms. However, if the member does not agree to the amended Terms, the member may terminate the service agreement. 5. If a member using a Paid Service terminates the service agreement because the member does not agree to an amendment to these Terms, the refund policy prescribed in separate Paid Service terms shall apply.

Article 4 (Interpretation of the Terms and Governing Rules)

1. The Company may establish separate terms of use and policies for individual services. If such terms or policies conflict with these Terms, the terms of use and policies for the individual service shall prevail. 2. Matters not specified in these Terms shall be governed by the Framework Act on Telecommunications, the Telecommunications Business Act, the Act on Promotion of Information and Communications Network Utilization and Information Protection (hereinafter referred to as the “Information and Communications Network Act”), the Personal Information Protection Act, and other applicable laws and regulations.

Chapter 2 Service Agreement

Article 5 (Application for Use)

1. A member who wishes to use the Service shall apply for use by entering the required information in the form prescribed by the Company. 2. All information entered by a member in the application form under Paragraph 1 shall be deemed to be true information. An applicant who does not enter his or her real name or actual information may not receive legal protection and may have the service agreement terminated or be restricted from using the Service.

Article 6 (Application for Use and Acceptance)

1. The Company shall accept applications for use under Article 5 in the order in which they are received, unless there are special circumstances. 2. The Company may restrict acceptance of an application for use in any of the following cases and may defer acceptance until the relevant reason is resolved: ① Where there is insufficient capacity in service-related facilities; ② Where a technical obstacle to providing or maintaining the Service occurs, or where a business-related obstacle prevents immediate acceptance of the application for use; ③ Where the Company determines that supplementation is necessary for incomplete information entered in the application for use under Article 5. 3. The Company may refuse to accept an application for use in any of the following cases: ① Where the application is not made under the applicant’s real name; ② Where the application is made using another person’s name; ③ Where information entered at the time of application is false or omitted; ④ Where the application is made for the purpose of undermining social peace and order or public morals; ⑤ Where the applicant has previously lost membership pursuant to Article 16, Paragraph 5; ⑥ Where, in using a Paid Service provided by the Company, the applicant has used or misappropriated another person’s credit card, wired or wireless phone, bank account, or other payment method without authorization; ⑦ Where other application requirements prescribed by the Company are incomplete. 4. If the Company defers or refuses acceptance of an application for use pursuant to Paragraph 2 or Paragraph 3, the Company shall notify the applicant thereof. However, this shall not apply where the Company cannot notify the applicant for reasons not attributable to the Company. 5. The Company may differentiate use by members in order to comply with ratings and age requirements under applicable laws, including the Promotion of the Motion Pictures and Video Products Act and the Youth Protection Act.

Article 7 (Notice to Members)

1. When the Company gives notice to a member, it may do so using the email address designated in advance by the member by agreement with the Company. 2. When the Company gives notice to an unspecified number of members, it may substitute individual notice by posting the notice on MBC Archive notices for at least one (1) week. However, matters that have a material effect on a member’s own transactions shall be notified individually.

Article 8 (Purchase Application)

A member may apply to purchase goods, etc. on MBC Archive by the following or similar methods, and the Company shall provide the following information in an easy-to-understand manner when the member applies to purchase goods, etc.: 1. Search for and selection of goods, etc.; 2. Confirmation of the terms, services for which refunds are restricted, minimum production costs, and other cost-bearing matters; 3. Purchase application for goods, etc. and confirmation thereof, or consent to the Company’s confirmation; 4. Selection of payment method.

Article 9 (Formation of Contract)

1. The Company may refuse to accept a purchase application under Article 8 if any of the following applies: ① The application contains false information, omissions, or errors; ② The resolution of portrait rights is unclear; ③ The Company determines that accepting the purchase application would cause significant technical difficulty for the Company. 2. The Company’s acceptance shall be made by email notice under Article 11, Paragraph 1, and the contract shall be deemed formed when the notice reaches the member who made the purchase application. 3. The Company’s expression of acceptance shall include confirmation of the member’s purchase application, availability of sale, and information on correction or cancellation of the purchase application.

Article 10 (Payment Methods)

A member may pay for goods, etc. purchased on MBC Archive by any of the following methods: 1. Credit card payment; 2. Real-time account transfer; 3. Bank transfer without a bankbook; 4. Other electronic payment methods.

Article 11 (Notice of Review Result, Payment, and Download)

1. When a member submits a purchase application, the Company shall notify the member by email of the review result and payment amount. 2. Payment is available within seven (7) days after the Company supplies the material through MBC Archive. 3. Download is available within seven (7) days after the member’s payment.

Article 12 (Protection of Personal Information)

1. The Company establishes and implements a personal information protection policy based on applicable laws and regulations that information and communications service providers must comply with, including the Protection of Communications Secrets Act, the Telecommunications Business Act, the Information and Communications Network Act, and the Personal Information Protection Act. However, these Terms and the Company’s personal information protection policy do not apply to other websites connected through banner advertisements or other links outside MBC Archive. 2. The Company may use member information for the Company’s various marketing, promotional, or service expansion purposes based on these Terms and the personal information protection policy. If a member does not wish to receive such information, the member may refuse receipt at any time. 3. The Company shall collect personal information only to the minimum extent necessary for providing the Service, but may collect and manage additional information necessary for providing and expanding the Service with the member’s consent. 4. The Company shall not disclose a member’s personal information externally or share it with a third party without the member’s consent. However, the following cases are exceptions: ① Where the member’s consent has been obtained; ② Where it is necessary to verify the identity of the member in order to use various services provided by the Company, such as viewer opinions or survey participation results left by the member on electronic bulletin boards through use of the Service; provided, however, that the Company provides personal information only to the minimum extent necessary; ③ Where provision of the member’s personal information is required by law or by lawful order of a court or other state agency; ④ Where necessary for payment settlement or delivery of goods in connection with provision of the Service; ⑤ Where information is provided in a form that cannot identify individuals for statistical compilation, academic research, or market research. 5. In the following cases, the Company may provide affiliated companies with limited information among the personal information collected from members so that such affiliated companies may use it. In such cases, a member may refuse unwanted services at any time by email or other means. ① Where affiliated internet shopping service providers, communication service providers, manufacturers, wholesalers and retailers, telecommunications companies, business service providers, educational service providers, entertainment, culture, and sports-related service providers, or other specialized content or business operators intend to conduct advertising and marketing activities using email, TM (telemarketing), DM (postal mail), SMS (mobile text message), etc., the Company shall transmit the information after obtaining the member’s prior consent to provide personal information to the affiliated company. ② Where affiliated financial and insurance businesses or related service providers, such as credit card, installment financing, insurance, insurance agency, or brokerage businesses, intend to conduct advertising and marketing activities using email, TM (telemarketing), DM (postal mail), SMS (mobile text message), etc., the Company shall transmit the information after obtaining the member’s prior consent to provide personal information to the affiliated company. 6. A member may view, correct, and update the personal information provided to the Company. In addition, even after consenting to provide personal information to the Company, the member may request withdrawal of consent (membership withdrawal) at any time. 7. In order to provide specialized customized services suited to each member’s personal environment or preferences, the Company uses “cookies” that store and retrieve member information from time to time. A cookie is a small amount of information transmitted by a website to the member’s computer web browser and may be stored on the PC hard disk. When a member accesses the website, the Company’s server reads the contents of the cookie in the member’s web browser and finds additional information about the member on the member’s computer, thereby providing the Service without requiring additional entry of the member’s name or other information upon access. Cookies identify the member’s computer but do not individually identify each member. By using cookies, the Company can identify the visit and usage patterns of each service visited by members, the scale of members, and other information, and can create more convenient services. Members may choose whether to use cookies by adjusting the options of their web browser. In other words, members may accept all cookies, receive notification when cookies are installed, or refuse all cookies. However, members must allow cookies in order to log in and use the Service after accessing the Company. 8. After achieving the purpose of collection or the purpose for which personal information was provided, the Company shall destroy the personal information without delay using a technical method that makes restoration impossible. However, where retention is required under laws such as the Commercial Act, where the member’s consent has been obtained, where the previously notified retention period has not expired, or where retention of relevant personal information is necessary for legal response because litigation or a dispute has arisen or may arise, the Company may retain the personal information for the necessary period. During such period, however, viewing and use of the personal information shall be limited to the relevant reason. If continued retention is necessary thereafter, the Company shall notify the member of this fact and obtain consent. 9. If a member does not use the Service for a long period of time, the Company may set a membership cleanup period, notify the member through MBC Archive or email that the service agreement may be terminated if the Service is not used for a certain period, and, if the member does not use the Service or raise a separate objection during that period, terminate the member’s membership and delete the member’s personal information. 10. Personal information provided or consented to for use after the Company has indicated that it is for a temporary purpose, such as an event or survey, shall be completely deleted from the disk by a method that cannot be restored according to the member’s intention after that purpose has been achieved.

Article 13 (Changes to Contract Information)

1. A member may view and modify his or her personal information at any time through the personal information management screen. However, some information necessary for management and maintenance of the Service, such as real name and ID, may not be modified at the member’s discretion. 2. If information entered at the time of application for use changes, the member must modify it using the online form provided by the Company. The Company shall not be responsible for disadvantages arising from the member’s failure to change member information.

Article 14 (Rights Relating to Member ID and Password)

1. The member is responsible for managing his or her Member ID and password and shall not allow a third party to use them. 2. The Company may restrict the use of a Member ID if any of the following reasons applies: ① Where the Member ID is similar to the password or is otherwise deemed likely to be a clue to leakage of personal information; ② Where the Member ID is recognized as an expression that is antisocial or contrary to public morals; ③ Where the Member ID may be mistaken for the Company, an operator of the Company, or a related person. 3. A member shall immediately notify the Company and follow the Company’s appropriate guidance and instructions if the member becomes aware that his or her Member ID or password has been stolen or is being used by a third party. 4. Notwithstanding Paragraph 1, the Company shall not be responsible for disadvantages arising because a member allows a third party to use his or her Member ID and password, fails to notify the Company under Paragraph 3, or fails to properly follow the Company’s guidance and instructions after notification.

Chapter 3 Obligations of the Contracting Parties

Article 15 (Obligations of the Company)

1. Unless there are special circumstances, the Company shall make the Service available on the day the member applies to use the Service. 2. The Company shall continuously endeavor to provide continuous and stable service in accordance with these Terms, and shall repair or restore facilities without delay if any facilities are disabled or lost. However, in the event of natural disasters, emergencies, other unavoidable circumstances, or where provision of the Service is difficult due to the Company’s circumstances, the Company may temporarily suspend or discontinue the Service. 3. If the Company recognizes that opinions or complaints raised by a member through the prescribed procedures are justified, the Company shall process them through appropriate procedures. If processing requires a certain period of time, the Company shall notify the member of the reason and processing schedule. 4. The Company shall comply with the provisions concerning protection of personal information set forth in these Terms and other laws and regulations in relation to the protection of members’ privacy. 5. The Company shall endeavor to provide convenience to members in procedures and matters relating to contracts with members, including conclusion of service agreements, changes to contract information, and termination.

Article 16 (Obligations of Members)

1. Members shall comply with applicable laws and regulations, each provision of these Terms, usage guides, and precautions announced or notified in connection with the Service, and shall not engage in any act that interferes with the Company’s business. 2. Members shall comply with restrictions on use posted by the Company in service notices or separately announced for each type of content. 3. Members may not use the Service for business or other profit-making activities without the Company’s prior approval. The Company shall not be responsible for the results of such business activities or for consequences arising from a member’s business activities in violation of the Terms. If the Company suffers damage due to such business activities, the member shall be liable to compensate the Company for damages. 4. Members may not transfer or gift their rights to use the Service or other status under the service agreement to another person, or provide them as collateral, without the Company’s express consent. 5. Members shall not engage in any of the following acts in connection with use of the Service: ① Entering false information when applying for use or changing personal information; ② Collecting or misappropriating another member’s ID, password, or other personal information; ③ Reproducing, transmitting, or using information posted or provided through the Service for purposes other than use within the Service without the Company’s prior approval; ④ Infringing the patent, trademark, trade secret, copyright, or other intellectual property rights of the Company or another person; ⑤ Posting, transmitting, disclosing, or otherwise disseminating to a third party through the Company’s Service obscene or violent content, or any text, figures, messages, images, audio, or other information that causes disgust to others or is contrary to public order and morals; ⑥ Damaging the reputation of, or interfering with the business of, the Company or another person; ⑦ Infringing the rights of another person relating to portrait, name, or privacy; ⑧ Hacking the Company’s Service or other systems, or transmitting or distributing viruses, spyware, or other malicious code, thereby interfering with the normal operation of the Service or obstructing another person’s use of or access to the Service; ⑨ Posting or registering content or sending mail by impersonating or pretending to be an employee or administrator of the Company; ⑩ Any other act that violates applicable laws and regulations or standards and guidelines concerning the Company’s other service terms of use.

Chapter 4 Use of Service

Article 17 (Provision of Service, etc.)

1. The Company provides the following services to members: ① Preview services for materials such as video, audio, and images; ② Material ordering and payment services, and material download services; ③ Any other services additionally developed by the Company or provided to members through partnership agreements with other companies. 2. The Company may temporarily suspend provision of the Service in the event of maintenance, inspection, replacement, or failure of information and communications facilities such as computers, communication interruption, or other substantial operational reasons. In such cases, the Company shall notify members in the manner prescribed in these Terms; provided, however, that if there is an unavoidable reason that prevents the Company from giving prior notice, the Company may give notice afterward. 3. The Company may conduct regular inspections if necessary for provision of the Service, and the regular inspection times shall follow the notices posted on the service provision screen. 4. The Company provides information on the minimum technical specifications necessary to use each service in the notices of MBC Archive. Before using each service, members must confirm whether the specifications of the device to be used for the service and the quality of wired or wireless communication networks are suitable for use of the service. 5. In using the Service, members may be required to install programs installed for purposes such as video playback, patches, and updates, including clients (hereinafter referred to as “Programs”), and additional programs, software, etc. necessary for smooth operation of the Programs (hereinafter referred to as “Additional Programs”). Installation of Programs and Additional Programs is necessary to use the services provided by the Company, and the size and type of installed programs may vary depending on the content of the service provided. Each program may be deleted by selecting it under “Control Panel > Add/Remove Programs.”

Article 18 (Changes to the Service, etc.)

1. The Company may change all or part of the services it provides according to operational or technical needs. 2. If there is a change to the content, method of use, or hours of use of the Service, the Company shall post the reason for the change, the content of the service to be changed, the date of provision, and other relevant matters on the initial screen of the relevant service for at least seven (7) days before the change. 3. The Company may modify, suspend, or change all or part of the services provided free of charge according to the Company’s policies and operational needs.

Article 19 (Provision of Information)

1. The Company may provide members with various information deemed necessary for use of the Service by means of notices, email, or other methods. 2. In order to provide members with convenient and diverse services, the Company may use personal information collected from members within the procedures and limitations prescribed by applicable laws and regulations to advertise or provide information on various services offered by the Company, advertisements for goods or services of other companies, events, and the like, directly or together with affiliated companies, by email, DM (postal mail), or other methods. In such cases, members may refuse services and advertisements by email or other means at any time, except for transaction-related information under applicable laws and responses to customer inquiries. 3. If the Company intends to send information to members by TM (telemarketing), SMS (mobile text message), or facsimile transmission devices in conducting other marketing and promotional activities, such as information about the Service, the Company shall obtain the member’s prior consent before sending such information. However, this shall not apply to transaction-related information of members and responses to customer inquiries. 4. The Company may place advertisements on service screens, the website, emails, and other media in connection with operation of the Service, and a member who receives an email or other message containing advertisements may refuse receipt. 5. Other details concerning provision and use of member information shall be governed by the personal information protection policy prescribed by the Company.

Article 20 (Fees and Paid Information, etc.)

1. The services provided by the Company include free services and paid services. Separate paid information provided by the Company and its affiliated companies may be used only after paying the fee specified for the relevant information. 2. A member who wishes to use a Paid Service provided by the Company must, in addition to agreeing to these Terms, agree to the terms of use for Paid Services and passes and pay the usage fee (or membership fee) to the Company.

Article 21 (Member Posts)

1. If the Company determines that information consisting of text, documents, drawings, audio, or combinations thereof, written, posted, or registered by a member within the Service (hereinafter referred to as “Posts”), falls under any of the following categories, the Company may delete or move the Post or refuse registration without prior notice: ① Content that slanders another person or damages another person’s reputation; ② Content that violates public order and morals; ③ Content recognized as being connected to criminal acts; ④ Content that infringes the copyright or other legally protected rights of the Company or another person; ⑤ Content that exceeds the posting period prescribed by the Company; ⑥ Where a member posts obscene materials on a bulletin board or links to an obscene site; ⑦ Posts that violate the posting and writing principles prescribed by the Company or do not conform to the nature of the bulletin board; ⑧ Content that interferes with the normal operation of the Company’s Service; ⑨ Advertising content for profit-making purposes; ⑩ Content deemed to violate other applicable laws and regulations. 2. If a member’s Post includes content that violates the Act on Promotion of Information and Communications Network Utilization and Information Protection, the Copyright Act, the Personal Information Protection Act, or other applicable laws and regulations, the rights holder may request suspension of posting or deletion of the relevant Post in accordance with the procedures prescribed by applicable laws and regulations, and the Company shall take measures in accordance with applicable laws and regulations. 3. Even in the absence of a request by a rights holder under Paragraph 1, if there is a reason to recognize infringement of rights or if a Post otherwise violates Company policy or applicable laws and regulations, the Company may take temporary measures or other actions regarding the relevant Post in accordance with applicable laws and regulations.

Article 22 (Ownership of Copyright and Restrictions on Use)

1. Copyright and other intellectual property rights in the Service belong to the Company. However, member Posts and works provided based on partnership agreements or other arrangements are excluded unless they directly post MBC broadcast programs. 2. A member shall not use, for profit-making purposes, information obtained through use of MBC Archive in which intellectual property rights belong to the Company, by reproduction, transmission, publication, distribution, broadcasting, or any other method, nor allow a third party to use such information, without the Company’s prior approval. 3. If the Company uses copyright belonging to a member pursuant to an agreement, the Company shall notify the member thereof.

Article 23 (Placement of Advertisements and Transactions with Advertisers)

1. The Company may place advertisements in the form of banner advertisements, etc. in the process of providing MBC Archive, emails sent to members, and other services. 2. With respect to promotional activities of advertisers conducted pursuant to Paragraph 1, members participate in or transact in such promotional activities at their own responsibility, and the Company shall not be liable for damages or losses incurred by either party in transactions or negotiations between advertisers and members.

Article 24 (Responsibility for Use of the Service)

1. Except where specifically permitted through an express written document signed by an authorized employee of the Company, members may not conduct business activities such as selling goods by using the Service, and in particular may not engage in commercial activities through hacking, money-making advertisements, obscene sites, or the illegal distribution of commercial software. The Company shall not be responsible for the results and losses of business activities conducted in violation of this provision or for legal measures such as detention by relevant authorities. 2. The following acts, if not agreed to or consented to by the Company, constitute copyright infringement and acts of unfair competition, and the Company may take civil and criminal action against the actor and related responsible persons: ① Accessing the Company’s web, app, or server, or monitoring, reproducing, collecting, confirming, organizing, or using content and information included in the Company’s services, by using robots (bots), crawlers, spiders, scrapers, macro programs, or other automated means or manual processes to extract data, etc., without the Company’s express prior written permission, is not permitted. ② Any person who intends to use the content of any content and online services provided through the Service, or any content distributed through external platforms, or to use such content for artificial intelligence (AI) training purposes, must reach prior agreement with the Company. In particular, use for profit-making purposes must be based on a lawful contract with the Company. Even for public-interest and non-profit purposes, the Company’s consent must be obtained.

Article 25 (Suspension of Service Provision, etc.)

1. In the case of free services, the Company may modify or suspend all or part of the Service as necessary for the Company. 2. The Company may suspend provision of the Service in any of the following cases: ① Where unavoidable due to construction such as maintenance of service facilities; ② Where a key telecommunications business operator prescribed under the Telecommunications Business Act has suspended telecommunications services; ③ Where provision of the Service is difficult due to the Company’s circumstances or there is a force majeure event. 3. If normal use of the Service is impeded due to a national emergency, power outage, failure of service facilities, excessive use of the Service, or similar circumstances, the Company may restrict or suspend all or part of the Service.

Chapter 5 Termination of Agreement and Restrictions on Use

Article 26 (Termination of Agreement and Restrictions on Use)

1. A member may apply to the Company for membership withdrawal at any time through the form provided online. 2. If a member engages in any of the following acts, the Company may terminate the service agreement without prior notice or suspend use of the Service for a specified period: ① Misappropriating another person’s personal information, Member ID, or password, or registering with false information; ② Engaging in identity theft or misappropriation of a payment method in violation of the Resident Registration Act; ③ Where the same user double-registers using another member’s ID; ④ Damaging another person’s reputation, insulting another person, or otherwise causing disadvantage; ⑤ Infringing intellectual property rights of the Company, another member, or a third party; ⑥ Intentionally disseminating content that undermines public order and morals; ⑦ Using the Service for profit-making purposes or interfering with another person’s use of the Service; ⑧ Intentionally interfering with the Company’s operation of the Service; ⑨ Transmitting a large amount of information or advertising information for the purpose of interfering with stable operation of the Service; ⑩ Distributing computer virus programs that cause malfunction of information and communications facilities or destruction of information, such as provision of illegal programs or interference with operation in violation of the Computer Program Protection Act, or distribution of malicious code in violation of the Act on Promotion of Information and Communications Network Utilization and Information Protection; ⑪ Where a corrective request has been made by the Information and Communications Ethics Committee or other relevant administrative agency, or where an authoritative interpretation has been received from the National Election Commission in relation to illegal election campaigns; ⑫ Reproducing, distributing, or commercially using information obtained by using the Company’s service information without the Company’s prior approval; ⑬ Posting obscene materials on a bulletin board or linking to obscene sites; ⑭ Causing interference with use of the Service or the Company’s systems by unlawful methods or for unjust purposes in violation of applicable laws and regulations, including illegal communications, hacking, or acts exceeding access authority; ⑮ Violating these Terms or other conditions of service use prescribed by the Company. 3. If a member engages in acts under Paragraph 2 or violates obligations under these Terms, the Company may gradually restrict use of the Service, such as by warning, temporary suspension, or permanent suspension of use, depending on the seriousness of the violation. 4. The Company may establish detailed procedures regarding the conditions and details of separate restrictions on use in order to ensure lawful use of the Service and protect members in accordance with these Terms. 5. A member may immediately file an objection to restrictions on use under these Terms in accordance with the procedures prescribed by the Company. If the reason for the objection is recognized as justified, the Company shall immediately resume use of the Service. If it is proven that the member acted without intent or negligence, the period of use of the Paid Service shall be extended by the period of account suspension.

Chapter 6 Compensation for Damages and Miscellaneous

Article 27 (Compensation for Damages)

1. With respect to losses or damages incurred by a member in the course of using free services provided by the Company, the Company shall be liable for damages that have a substantial causal relationship with the Company’s intent or negligence. However, the Company shall not be liable for the mere fact that the member could not use free services. 2. The Company shall not be responsible for goods or services handled by affiliated companies.

Article 28 (Disclaimer)

1. If the Company is unable to provide the Service due to natural disasters or equivalent force majeure events, or other reasons not attributable to the Company, the Company shall be exempt from responsibility for provision of the Service. 2. The Company shall not be responsible for service use interruptions caused by reasons attributable to a member. 3. The Company does not guarantee the reliability, accuracy, legality, stability, or other qualities of information, materials, or facts posted, disseminated, or transmitted by members through the Service. 4. The Company shall not be responsible for transactions conducted through the Service between members or between a member and a third party. 5. The Company shall not be responsible in connection with use of services provided free of charge, unless otherwise specifically provided by applicable law.

Article 29 (Governing Law and Jurisdiction)

1. Lawsuits filed between the Company and members shall be governed by the laws of the Republic of Korea. 2. If a lawsuit is filed concerning a dispute arising from use of the Service, jurisdiction shall be determined by the member’s address at the time of filing; if there is no address, the court having jurisdiction over the location of the Company’s head office shall have exclusive jurisdiction. 3. If the member’s address at the time of filing is unclear, the court of jurisdiction shall be determined in accordance with the Civil Procedure Act.

(Effective Date) These Terms shall apply from December 1, 2025, and the previous terms shall be replaced by these Terms.

회사는 개인정보 보호를 위해 기술적인 측면과 관리적인 측면에서 다음과 같은 조치를 취하고 있습니다.

Regarding the privacy policy, Munhwa Broadcasting Corporation and iMBC Co., Ltd. 1. Purpose of Collection and Use of Personal Information

Members’ personal information is collected and used for the purposes of establishing the service use agreement (including identification of the user and confirmation of the user’s intent), performing the service (including payment settlement and product delivery), and providing information on other new services, new products, or events.
In addition, in order to provide members with convenient and diverse services, the Company may use personal information collected from members to conduct advertising or marketing activities for various services provided by the Company by email, TM (telemarketing), DM (postal mail), SMS (mobile text message), and other methods. In such cases, members may refuse unwanted services at any time by email or other means.

2. Items of Personal Information Collected

The Company collects only the minimum personal information necessary to provide the service; however, if additional information is required, the Company may request such additional information. On the membership registration screen, the Company receives the following corporate and personal information items from members as required input items.

6. Access, Correction, Update, and Withdrawal of Consent (Membership Withdrawal)

Members may access, correct, update, and withdraw consent (membership withdrawal) for their registered personal information at any time.
That is, after logging in with the member ID and password through the LOG-IN menu and going to the member information modification menu, members may access, correct, and update all input information except the member ID, and may also withdraw consent to the provision of personal information through membership withdrawal.

7. Retention Period and Use Period of Personal Information

As follows, after the purpose of collection or the purpose for which personal information was provided has been achieved, the Company destroys personal information without delay by using a technical method that makes restoration impossible.

If a member has ceased using the service as a member for a long period of time, the Company may set a membership cleanup period, provide notice for a certain period through the site screen or by email, and, if the relevant member raises no objection, terminate that member’s membership and delete the related personal information accordingly.

In principle, members’ personal information is destroyed without delay once the purpose of collecting and using the personal information has been achieved.

The Company uses cookies, which store and retrieve members’ information from time to time, in order to provide customized services tailored to members. Cookies are small pieces of information that a website sends to the member’s computer web browser and may be stored on the PC hard disk. When a member accesses the website, the Company’s server reads the contents of the cookies in the member’s web browser and finds additional information about the member on the member’s computer, thereby providing services without requiring additional input such as the member’s name upon access.

A. Purpose of Using Cookies
- Cookies identify a member’s computer, but do not individually identify each member. The Company uses these cookies to understand the visit and usage patterns and usage scale for each service visited by members, and to create more convenient services. 11. Use for Purposes Other Than Intended and Provision (or Sharing) to Third Parties

The Company does not disclose personal information provided by members to the outside or share it with third parties without the member’s consent. However, exceptions are made in any of the following cases:

① Where the member’s consent has been obtained ② In order to allow members to use the services of the Company and its affiliates with a single member ID assigned by the Company without a separate membership registration procedure, the Company may provide the personal information it holds about a member who wishes to use the service of a specific affiliate to the relevant affiliate. (This also applies if affiliates are added after the member’s initial service application.)
